Removal Expenses
Members will be aware of the difficulties that arose as a consequence of the polarised position with regard to the reimbursement of Stamp Duty following transfer. The Joint Branch Board's position on this subject was consistent and that the Force had no lawful authority to 'cap' reimbursement of this expense at £2500.00.
The issue was ultimately progressed to the Joint Liaison Group (JLG) where your Representatives presented a compelling case in this regard. Members will recall, following the meeting of the JLG, the Northern Joint Police Board was to secure legal advice on the matter in order to consider their position.
The Joint Branch Board welcomed the announcement of the Chief Constable, in his core brief of 6th March 2008; should legal opinion indicate the cap is not justifiable … it will be removed immediately.
The Joint Branch Board welcomes the further announcement of the Chief Constable, in his core brief of 18th April; initial advice indicates that the blanket cap is not sustainable.
Whilst this announcement infers the Joint Branch Board's position on this subject has been vindicated, clarification has been sought from the Force.
